Hecker Fink Helps Defeat Supreme Court Bid to Strip Detained Immigrants of Due Process Protections

On Friday, Hecker Fink, together with co-counsel at the American Civil Liberties Union, New York Civil Liberties Union, and MacArthur Justice Center, secured the dismissal of Genalo v. G.M., a U.S. Supreme Court appeal in which the government argued that immigrants in prolonged ICE detention do not enjoy due process protections.
Hecker Fink client Keisy G.M., a lawful permanent resident who had been held in ICE detention for 21 months without a bond hearing, argued that the Supreme Court case was moot after New York Governor Kathy Hochul pardoned Mr. G.M. in August, eliminating the sole basis for his deportation and detention. After Mr. G.M. filed his merits brief, the government agreed the case was moot and stipulated to dismissal of its appeal. As a result, the underlying decision of the Second Circuit requiring due process protections for immigrants in prolonged detention will remain in place.
The Hecker Fink team includes Matthew Craig, Susan Har, Atticus Ballesteros, and Aly Kersley.
