Earlier this year, two district courts blocked Trump Administration rules that create sweeping exemptions from the Affordable Care Act’s contraceptive coverage requirement, and would ultimately shift the cost of coverage onto thousands of women. But the First Amendment’s Establishment Clause bars the government from providing religious accommodations that substantially harm third parties.
