Hecker Fink LLP filed an amicus brief in Perkins Coie LLP v. United States Department of Justice et al. in the U.S. Court of Appeals for the D.C. Circuit on behalf of 20 former senior government officials in support of Perkins Coie and three other law firms (Jenner & Block, WilmerHale, and Susman Godfrey) that have been targeted in ad hominem, punitive, and retaliatory executive orders from the White House designed to intimidate law firms from upholding the rule of law.

The brief draws on the experience of the amici, a bipartisan group of former national security, foreign policy, intelligence, legal, and other public officials who have worked on security matters at the most senior levels of the United States government.

As stated in the brief, nothing in the history of our country provides the President with a general national security power to sanction U.S. citizens or entities simply because they disagree with him. Left unchallenged, the President’s executive orders threaten the rule of law and violate bedroom separation of powers principles and the constitutional protection against bills of attainder.
